Terms of Service

1. Acceptance of Terms

By accessing or using AppraisalHawk's services, including our mobile application, desktop software, and website (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

AppraisalHawk provides software tools designed to assist real estate appraisers with:

  • Field data capture (photos, voice notes, property observations)
  • Automated data extraction from MLS systems and public records
  • Automated form filling for appraisal software (WinTOTAL, ACI, etc.)

Important: AppraisalHawk is a productivity tool. It does not provide appraisal services, property valuations, or professional advice. All final appraisal judgments, conclusions, and certifications remain your responsibility as a licensed appraiser.

3. Account Registration

To use our Services, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Payment

Fees

Access to AppraisalHawk requires a paid subscription. Fees are billed monthly or annually as selected during signup. Prices are subject to change with 30 days notice.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months or unused portions of your subscription.

Free Trials

We may offer free trials. At the end of a trial, you will be automatically charged unless you cancel before the trial ends.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble our software
  • Interfere with or disrupt the Services or servers
  • Share account credentials with unauthorized users
  • Use the Services to collect data without proper authorization
  • Represent that automated outputs are your own analysis without review

6. Intellectual Property

AppraisalHawk and its licensors own all rights to the Services, including software, designs, and content. You receive a limited, non-exclusive license to use the Services for your internal business purposes.

You retain ownership of all data you input into the Services, including photos, voice recordings, and inspection data.

7. AI and Automation Disclaimer

Our Services use artificial intelligence and automation to assist with data entry and form filling. While we strive for accuracy:

  • AI is not perfect. Automated outputs may contain errors. You are responsible for reviewing and verifying all data before submission.
  • Human judgment is required. Appraisal conclusions, value opinions, and professional certifications must be made by a licensed appraiser.
  • We do not guarantee compliance. You are responsible for ensuring your appraisals meet all applicable standards and regulations.

8. Third-Party Services

Our Services may interact with third-party platforms (MLS systems, county websites, appraisal software). We are not responsible for:

  • The availability or accuracy of third-party data
  • Changes to third-party interfaces that may affect our Services
  • Your compliance with third-party terms of service

You are responsible for maintaining valid credentials and authorizations for any third-party services you access through AppraisalHawk.

9. Privacy

Your use of the Services is subject to our Privacy Policy, which is incorporated by reference into these Terms.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPRAISALHAWK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless AppraisalHawk, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorney fees) arising from your use of the Services or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:

  • Your license to use the Services ends immediately
  • You may export your data for 30 days after termination
  • We may delete your data after the export period unless required by law to retain it

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Services. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

16. General

These Terms constitute the entire agreement between you and AppraisalHawk regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
